What is the Personal Data Regulation?
The purpose of the Personal Data Regulation is to support the digital single market by introducing uniform rules throughout the EU.
In addition, the regulation must strengthen the rights of data subjects by giving them greater control over their own data. The Personal Data Regulation applies to everyone who processes personal data, including companies that register information about their employees.
Why it was important to become compliant by 25 May 2018?
When the Personal Data Regulation entered into force on 25 May 2018, it meant that all companies and organizations that collect, process, register and store personal data had to meet a number of new and/or stricter requirements.
If these requirements are not met, administrative fines of up to €20 million can be issued. or 4% of the company's or group's global turnover. So it is therefore very important to have control over your data processing.

The regulation strengthens the rights of data subjects by giving them greater control over their own data. The Personal Data Regulation applies to everyone who processes personal data, including companies that register information about their employees.
Special importance in relation to employees:
The Personal Data Regulation is about much more than recording information about the company's employees, and it is a very comprehensive set of rules. In relation to employees, companies must be especially aware of the following changes compared to the previous Personal Data Act:
Significantly increased level of fines: Administrative fines of up to €20 million will be issued. or 4% of the company/group's global turnover. This is a very large increase in the fine level compared to what currently applies in Denmark.
Consent: There are stricter requirements for consent from the registered person when information about employees or job applicants is registered. The rules depend on the Danish implementation of the rules, e.g. in relation to the possibility of obtaining criminal records.
Data protection officer: Public and certain private companies must appoint a data protection officer (a so-called DPO). It can either be an employee or an external person. If it is an employee, that person will be covered by the regulation's rules on dismissal protection.
One-stop shop for groups: This should provide a simpler personal data process for companies with operations in several countries.
Data security: Companies must inform relevant authorities about breaches of data security.
DA's salary statistics: The rules do not prevent the collection of data for DA's salary statistics. Access to this must finally be secured in connection with the Danish implementation of the rules.
The Personal Data Regulation also contains many initiatives that may have an impact on the employees, e.g. increased requirements for "privacy by design" and the "right to be forgotten"
